Terms of Use

These terms apply to the use of photobooth-free.com ("Photobooth Free"), including the embedded photo booth and the interface for AI assistants.

Provider and scope

(2) By using the photo booth you accept these terms. No account is required.

Service

(1) Photobooth Free is a free photo booth in your browser: you take photos with your device's camera, choose effects and layouts and can download, print or share the collages. Processing happens on your device; photos are not uploaded to our servers.

(2) Use is free of charge. There are no paid features, no subscription and no in-app purchases. Links to our sister service guest-pictures.com lead to a separate service with its own terms.

(3) You need an up-to-date browser and, for live shots, a camera. We keep developing the photo booth and may change, add or discontinue features. There is no entitlement to specific features or uninterrupted availability.

Your photos and your responsibility

(1) Your photos belong to you; we never receive them and claim no rights to them.

(2) If you photograph other people, please respect their rights: only publish or share photos with the consent of the people shown (for children: their parents). If you set up the booth for others (e.g. at a party), let the guests know and clear the gallery on the device after the event.

(3) The photo booth must not be used for unlawful purposes, such as covert recordings, images of a person's most private sphere without consent, or spreading illegal content.

Permitted use

(1) You may use the photo booth privately and for your own events, including events of your company.

(2) Not permitted are: interfering with the technology, circumventing protective measures, automated bulk requests that put excessive load on our servers, and copying, rebuilding or reselling the photo booth or its content (software, design, texts, effects) as your own offering.

Embedding on your website

(1) You may embed the photo booth on your website free of charge using the code (iframe) we provide. The code must not be modified, and the visible credit with a link to photobooth-free.com must remain. The embedding must not suggest that the photo booth is your own product and must not take place on pages with illegal content.

(2) The embedded photo booth processes data in accordance with our privacy policy. You are responsible for your own website and for informing your visitors that you embed content from photobooth-free.com.

(3) We may change or end the embedding feature at any time and prohibit embedding on individual websites.

Interface for AI assistants

AI assistants may use our interface at photobooth-free.com/mcp to point people to the photo booth. Responses from the interface must not be presented in altered form as statements by us. We may restrict access in the event of excessive use or abuse.

Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and to the extent of any guarantee we have given.

(2) In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for the contract. Essential contractual obligations are those whose fulfilment makes proper use possible in the first place and on whose observance you may regularly rely. Otherwise, we are not liable for slight negligence.

(3) Photos and collages are stored only on your device (in the "with a friend" mode also on your friend's device, which receives the shared photos directly). Please download collages you want to keep; browsers may delete locally stored data on their own in some circumstances.

Changes to these terms

We may change these terms for the future, e.g. when the photo booth or the law changes. The version published at the time of your use applies.

Final provisions

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you additionally keep the protection of the mandatory provisions of the country in which you have your habitual residence.

(2) If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Frankfurt am Main. For consumers, the statutory places of jurisdiction apply.
